As we can accept your order and make a legally enforceable agreement without further reference to you, you must read these terms and conditions to make sure they are acceptable to you. If you have any queries, please contact us on 0191 296 1024.
Application
These Terms and Conditions will apply to the purchase of the goods by you (the Customer or you). We are Colena Ltd T/A heliguy™, a company registered in England and Wales under number 05819252 whose registered office is at Unit 9, Jupiter Court, Tyne and Wear, NE29 7SE, with email address info@heliguy.com and telephone number 01912961024 (the Supplier or us or we).
These are the terms on which we sell all Goods to you. By ordering any of the Goods or Services, you agree to be bound by these Terms and Conditions.
Interpretation
- Consumer
- an individual acting for purposes which are wholly or mainly outside their trade, business, craft or profession.
- Contract
- the legally-binding agreement between you and us for the supply of the Goods.
- Delivery Location
- the Supplier's premises or other location where the Goods are to be supplied, as set out in the Order.
- Durable Medium
- paper or email, or any other medium that allows information to be addressed personally to the recipient and stored for future reference.
- Goods
- the goods advertised on the Website that we supply to you of the number and description set out in the Order.
- Order
- the Customer's order for the Goods, submitted following the step-by-step process set out on the Website.
- Privacy Policy
- the terms which set out how we deal with confidential and personal information received from you via the Website.
- Website
- our website www.heliguy.com on which the Goods are advertised.
Goods
The description of the Goods is as set out in the Website, catalogues, brochures or other form of advertisement. Any description is for illustrative purposes only and there may be small discrepancies in size and colour. For Goods made to your special requirements, it is your responsibility to ensure the information or specification you provide is accurate. All Goods are subject to availability. We can make changes to the Goods necessary to comply with any applicable law or safety requirement, and will notify you of these changes.
Personal Information
We retain and use all information strictly under the Privacy Policy. We may contact you by email or other electronic communication and by pre-paid post, and you expressly agree to this.
If you are a consumer
These clauses apply only if you are a consumer (a person buying a Product for personal use, not for Commercial Operations). As a consumer, you have legal rights in relation to a Product that is faulty or not as described; advice is available from your local Citizens' Advice Bureau or Trading Standards office, and nothing in these Terms affects those rights.
If you are a business customer
These clauses apply only if you are a business customer (e.g. a UAV operator business). If you are not a consumer, you confirm you have authority to bind any business on whose behalf you use our site. These Terms and any document referred to in them constitute the entire agreement between us, and you acknowledge you have not relied on any statement not set out in them.
Basis of Sale
The description of the Goods does not constitute a contractual offer to sell. When an Order is submitted, we can reject it for any reason, although we will try to tell you the reason without delay. A Contract is formed only when you receive an email from us confirming the Order (Order Confirmation). Any quotation is valid for a maximum of 30 days from its date unless withdrawn earlier. No variation can be made after the Contract is entered into unless agreed by both parties in writing.
Price and Payment
The price of the Goods and any additional charges is set out on the Website at the date of the Order. Prices and charges include VAT at the rate applicable at the time of the Order. You must pay by submitting your credit or debit card details with your Order, and we can take payment immediately or before delivery.
On receipt of valid purchase orders, businesses may apply for a credit account, subject to our credit facility terms; approval and credit limits are at our sole discretion and we may conduct credit checks. Credit accounts require strict adherence to payment terms. We reserve the right to apply interest to overdue invoices, calculated at the Bank of England base rate plus 3% per annum, accruing daily from the due date until payment.
Delivery
- We will deliver to the Delivery Location within the agreed period or, failing agreement, without undue delay and in any event not more than 30 days after the Contract is entered into.
- If we do not deliver on time you may, in addition to other remedies, treat the Contract at an end where we have refused to deliver, where timely delivery was essential, or where you specified an appropriate later period that we failed to meet.
- If you treat the Contract as at an end, we will promptly return all payments made under it.
- Where Goods form a commercial unit you cannot cancel or reject some without the rest.
- We do not generally deliver outside England and Wales, Scotland, Northern Ireland, the Isle of Man and the Channel Islands; where we accept such an Order you may need to pay import duties or taxes.
- The Goods become your responsibility from completion of delivery or collection. You must, if reasonably practicable, examine the Goods before accepting them.
Risk and Title
Risk of damage to, or loss of, the Goods passes to you on delivery. You do not own the Goods until we have received payment in full. If payment is overdue or a step occurs towards your bankruptcy, we may by notice cancel delivery and end your right to use Goods still owned by us, in which case you must return them or allow us to collect them.
Cancellations & Refunds Due to Sanctions
If an order cannot be fulfilled due to newly imposed trade restrictions, sanctions or regulatory actions, we reserve the right to cancel the order without a refund where delivery is legally prohibited, offer an alternative product at your discretion, or refund only the unaffected portion of the order value. We shall not be responsible for any financial losses, operational disruptions or additional costs arising from such cancellations.
Right to Cancel
Subject to these Terms, you can cancel this contract within 14 days without giving any reason. The cancellation period expires 14 days from the day you (or a third party other than the carrier) acquire physical possession of the last of the Goods. To exercise the right, inform us of your decision by a clear statement — for example by email to info@heliguy.com. To meet the deadline it is sufficient to send your communication before the cancellation period expires.
Effects of Cancellation & Deductions
If you cancel, we will reimburse all payments received including standard delivery costs (except supplementary costs where you chose a non-standard delivery type). We may deduct for loss in value of Goods resulting from unnecessary handling beyond what is needed to establish their nature, characteristics and functioning. Diminished value includes, but is not limited to, damaged packaging, activating, and flying, and may incur drone service fees.
Timing of Reimbursement
- If we have not offered to collect the Goods, reimbursement will be made no later than 14 days after we receive the Goods back, or after you provide evidence you have sent them back, whichever is earlier.
- If we offered to collect, or no Goods were supplied, no later than 14 days after we are informed of your decision to cancel.
- We reimburse using the same means of payment you used, and you will not incur any fees as a result.
Returning Goods
Cancelled Goods must be sent back or handed over at Unit 9, Jupiter Court, Tyne and Wear, NE29 7SE without delay and not later than 14 days from your cancellation. You bear the cost of returning the Goods and will incur a restocking fee if the Goods have been activated and used. We are not liable for delay or failure to perform caused by events beyond our reasonable control, including acts of God, fire, flood, terrorism, war, governmental restrictions, or import/export embargoes.
Refunds for B2B & International Sales
Our extended returns policy does not apply to B2B or international customers; such returns are at heliguy's discretion and governed by this contract of sale.
Supply and Use of the Products
Unless otherwise agreed in writing, Products are intended for non-military use only. Neither party shall export technical data (or products incorporating it) in breach of UK, US or EU export laws. You are responsible for ensuring that the purchase, import, use or resale of any Product complies with all applicable laws, and for determining and obtaining any necessary export licences. We are not responsible for providing legal advice on export, and you agree to indemnify us against claims arising from your failure to comply.
Manufacture, Quality and Packing
We manufacture, pack and supply Products with reasonable skill and care in accordance with industry standards. We recommend you carry out full flight checks before flying. Any faults must be reported before the Product is flown — if you fly it, it will not be classed as faulty and no refund or return will be accepted. Refund or exchange cannot be claimed for crash or burning caused by non-manufacturing defects, unauthorised modification, entry of foreign bodies, or improper installation or operation. We expressly disclaim warranties for damage or failure due to magnetic interference. We warrant that Products will, for 21 days after delivery, conform to specification, be of satisfactory quality and be fit for purposes held out by us. To claim under this warranty, notify us of the defect as soon as reasonably possible and in any event within 3 days of discovery.
Acceptance and Defective Products
You may reject Products that do not materially comply with the Specification, provided notice is given within five Business Days of delivery for apparent defects, or within a reasonable time for latent defects (no later than 10 Business Days). Failing such notice, the Products are deemed accepted. On valid rejection you may require repair, replacement or full repayment; once we comply we have no further liability for that failure.
Lithium Polymer Batteries (LiPo, Li-Poly)
You agree to use any Lithium Polymer batteries in accordance with the manufacturer's instructions, check them regularly and store them appropriately. We recommend replacement after 250 cycles, and disposal in accordance with WEEE regulations. Fire can be caused by overcharging, charging a damaged cell, or short circuit; cells can be damaged by over-discharging, short circuit and crash damage. Many airlines do not permit carriage of LiPo batteries — check airline policies before flying with them. Misuse and inappropriate use is not covered under the warranty.
Our liability if you are a business
We supply Products for internal business use only and you agree not to resell them. Nothing limits our liability for death or personal injury caused by our negligence, or for fraud. Subject to that, we are not liable for loss of profits, sales, business or revenue; loss or corruption of data; loss of business opportunity, anticipated savings or goodwill; damage from use other than intended; indirect or consequential loss; or any modification you make. Our total liability shall not exceed 100% of the price paid for the Product to which the claim relates.
Conformity and Guarantee
We have a legal duty to supply Goods in conformity with the Contract. On delivery the Goods will be of satisfactory quality, reasonably fit for any particular purpose made known to us, and conform to their description. We give you the benefit of the manufacturer's guarantee, which takes effect on delivery and does not reduce your legal rights. We provide after-sales phone and email support and an out-of-warranty service centre.
Warranty & Service Restrictions Due to Regulatory Changes
If sanctions, trade restrictions or government regulations prevent us from obtaining parts, software or technical support from the manufacturer, we reserve the right to suspend or terminate warranty services without compensation, modify or replace affected components with functionally equivalent alternatives, or refuse repairs if legally prohibited. You acknowledge that government regulations may override manufacturer warranties.
Privacy
We respect your privacy and comply with the General Data Protection Regulation. These Terms should be read alongside our Privacy Policy and Cookies Policy. We are a Data Controller of the Personal Data we Process in providing Goods to you, and will identify the purposes of collection, process data only for those purposes, respect your rights, and implement technical and organisational security measures. Governing Law, Jurisdiction and Complaints
The Contract is governed by the law of England and Wales. Disputes may be submitted to the courts of England and Wales (or Scotland / Northern Ireland where the Customer lives there). If a dispute occurs, contact us and we will aim to respond with a solution within 7 days — call 0191 296 1024 or email info@heliguy.com.

3. Licence to use website
You may view, download for caching, and print pages from our website, stream audio and video, and use our website services via a web browser, subject to these terms. You must not otherwise download or save material, edit or modify material, or — unless you own the relevant rights — republish, sell, rent, sub-license, publicly show, commercially exploit or redistribute material from our website. We may restrict access to areas of the website at our discretion.
4. Acceptable Use
You must not use our website in any way that causes damage or impairs performance; for any unlawful, fraudulent or harmful purpose; to transmit malicious software; to conduct systematic or automated data collection (scraping, data mining, harvesting) without our written consent; to access it using any robot or spider; or to use collected data for direct marketing or to contact individuals or entities. You must ensure all information you supply is true, accurate, current, complete and non-misleading.
5. Products
The advertising of products constitutes an "invitation to treat" rather than a contractual offer. We may change available products at any time. Prices may be stated incorrectly. Sales are subject to our terms and conditions of sale, which we ask you to agree to at each purchase.
6. Registration and Accounts
To be eligible for an individual account you must be at least 18 years of age. Register by completing the registration form and clicking the verification link we email you. Notify us immediately of any unauthorised use of your account, and do not use another person's account without their express permission.
7. User IDs and Passwords
You will choose a user ID and password. Your user ID must not mislead or be used to impersonate any person. Keep your password confidential, notify us immediately of any disclosure, and accept responsibility for activity arising from any failure to keep it confidential.
8. Cancellation and Suspension of Account
We may suspend, cancel or edit your account at any time in our sole discretion without notice or explanation. You may cancel your account using your account control panel.
9–10. Your Content: Licence & Rules
"Your content" means all works and materials you submit to our website. You grant us a worldwide, irrevocable, non-exclusive, royalty-free licence to use, reproduce, store, adapt, publish, translate and distribute your content, with a right to sub-license and to bring infringement actions, and you waive your moral rights to the maximum extent permitted by law. Your content must comply with these terms, must not be illegal or infringe any person's rights, and must not be libellous, obscene, infringing, negligent, criminal, discriminatory, violent, pornographic, false, spam, or otherwise offensive. We may delete, unpublish or edit content that breaches these terms.
11. Report Abuse
If you learn of any unlawful material or activity, or any breach of these terms, please let us know by email or via our abuse reporting form.
12–13. Limited Warranties & Limitations of Liability
We do not warrant the completeness or accuracy of information published, that material is up to date, or that the website will remain available, and we may discontinue or alter services at any time. Nothing limits liability for death or personal injury from negligence, or for fraud. To the extent the website and its services are provided free of charge, we are not liable for any loss or damage; nor are we liable for events beyond our reasonable control, business losses, loss or corruption of data, or special, indirect or consequential loss. You agree not to bring claims personally against our officers or employees.
14. Breaches of These Terms
If you breach these terms (or we reasonably suspect you have), we may send warnings, temporarily suspend or permanently prohibit your access, block your IP, contact your ISP, commence legal action, and/or suspend or delete your account. You must not circumvent any such suspension or block.
15–21. Third-party Sites, Variation, Assignment, Severability, Third-party Rights, Entire Agreement, Law
Our website includes hyperlinks to third-party sites, which are not recommendations and for which we accept no responsibility. We may revise these terms from time to time. We may assign or sub-contract our rights and obligations; you may not without our consent. If any provision is unlawful or unenforceable, the remainder continues in effect. These terms are not intended to benefit any third party. Together with our privacy and cookies policy they constitute the entire agreement on your use of the website. They are governed by English law, with disputes subject to the exclusive jurisdiction of the courts of England.

These are the Terms and Conditions for the hire of drone equipment and related accessories.
1. About Us
We are Colena Ltd (trading as heliguy™), Unit 9, Jupiter Court, Orion Business Park, North Shields, Tyne and Wear, NE29 7SE, VAT number 875 0932 02. Your use of our site is governed by our terms of website use, and we use your personal information only in accordance with our Privacy Policy.
2. Forming a Contract
You can make an inquiry to hire online, by email or by phone, and we will send a quotation valid for 14 business days. After you submit an Order and agree to our quotation, we confirm acceptance by email specifying the type and quantity of Equipment, the Rental Period and Rental Payment, and an order number. We will not confirm acceptance until you have provided evidence of insurance and, for new customers, completed identity verification. The Contract is formed only when we send the Confirmation and your payment has been received.
3. Equipment Hire and Rental Period
New customers may be required to complete identity verification. You must declare the purpose(s) for which you are hiring the Equipment and where it will be used; use outside the UK requires our prior written consent. The Rental Period starts on the commencement date in the Order and continues for the agreed period unless terminated earlier. We warrant the Equipment shall be of satisfactory quality.
4. Delivery and Acceptance
We arrange delivery to the Delivery Location; time is not of the essence. You shall accept delivery on the day we first attempt it. If Equipment is damaged or missing you must inform us immediately. No deliveries will be made to residential addresses with shared or communal entrances (business addresses are exempt).
5. Deposit and Rental Payments
Any security deposit will be included in our quotation and held against loss or damage; we will release it within 5 Business Days at the end of the Rental Period provided all Equipment is complete and undamaged. Unless we agree credit terms (business customers only), the full Rental Payment is required before dispatch. The Rental Payment is inclusive of VAT. All invoices must be paid in full and in cleared funds within 14 days. The minimum rental term is 7 calendar days from the contract start date.
6. Title, Risk and Insurance
The Equipment remains our property at all times. Risk passes to you at delivery and remains with you until the Equipment is returned. During the Rental Period you must, at your own expense, maintain insurance of the Equipment for its full replacement value against all usual risks; third-party / public liability insurance; and aviation insurance complying with EC Regulation 785/2004. Policies must provide us at least 20 Business Days' notice of cancellation or material change and, on request, name us as loss payee. You must notify us immediately of any loss, accident or damage.
7. Customer Responsibilities
You must keep and operate the Equipment in a suitable environment by trained, competent individuals in accordance with operating instructions (including LiPo battery handling); not alter, repair or maintain it without our consent; permit us to inspect it; maintain operating records; not part with control, sell, sub-let or encumber it; not affix it permanently to land or buildings; ensure it remains identifiable as our property; not use it for any unlawful purpose; and return it at the end of the Rental Period. You must comply with all laws for the operation of unmanned aircraft, obtain and maintain all necessary CAA permissions, and obtain all necessary consents from landowners, Air Traffic Control, police and other stakeholders. You indemnify us against loss or damage arising from your negligence or misuse. We reserve the right to employ debt collection agencies and/or law enforcement if Equipment is not returned correctly or on time.
8. Cancellation and Termination
Business customers: cancellation more than 72 hours before the Rental Period — refund less reasonable administrative charges; less than 72 hours before or once started — a cancellation charge equal to the full Rental Payment (unless the Equipment is defective). Consumers (Consumer Contracts Regulations 2013): you may cancel within 14 days of commencement without reason; we reimburse all payments within 14 days, though if you ask us to begin the Rental Period during the cancellation period you pay a proportionate amount.
9. Termination
We may terminate immediately on written notice for material breach not remedied within 14 days, insolvency events, cessation of business, or deterioration of your financial position. We may suspend provision or terminate for non-payment. On termination you must immediately pay all outstanding invoices and interest.
10–11. Limitation of Liability & Force Majeure
Nothing limits liability for death or personal injury from negligence, fraud, or matters that cannot lawfully be excluded. Subject to that, we are not liable for loss of profit, revenue, business or any indirect or consequential loss, and our maximum aggregate liability shall not exceed the Rental Payment. Neither party is liable for delay or failure resulting from a Force Majeure Event; if it continues for 4 weeks, the unaffected party may terminate on 7 days' notice.
12. Other Important Terms
We may transfer our rights and obligations; you may transfer yours only with our written consent. No third party may enforce these Conditions. Each paragraph operates separately. No variation is effective unless in writing and signed by both parties. The Contract is governed by the law of England and Wales, with the exclusive jurisdiction of its courts. Equipment may be GPS tracked for loss prevention, and you consent to this tracking by entering into a rental agreement.
13. Model Cancellation Form
Complete and return this form only if you wish to withdraw from the contract, to: Colena Limited t/a heliguy™, Unit 9, Jupiter Court, Orion Business Park, North Shields, Tyne & Wear, NE29 7SE (Tel: 0191 296 1024; Email: info@heliguy.com) — giving notice of cancellation, details of the goods/service, dates ordered/received, and the consumer's name, address, signature and date.
14. Definitions
- Business Day
- a day (other than a Saturday, Sunday or public holiday) when banks in London are open for business.
- Confirmation
- our acceptance of the Order sent by email to you.
- Equipment
- the drone equipment (or any part of it) set out in the Order.
- Force Majeure Event
- an event or circumstance beyond a party's reasonable control.
- Rental Payment
- the payment made by or on your behalf for hire of the Equipment.
- Rental Period
- the period of hire as set out in the Order.

The Waste Electrical or Electronic Equipment (WEEE) Directive requires countries to maximise separate collection and environmentally friendly processing of these items. In the UK, distributors must provide a system allowing customers buying new electrical equipment to recycle their old items free of charge.
WEEE is taken back free of charge on a one-for-one, like-for-like basis. Waste batteries, including rechargeable batteries, are taken back free of charge, and you are not obliged to make any purchase when returning old batteries. Each local authority must also accept household WEEE and small batteries free of charge at its recycling facilities.
You can now recycle your old electricals with us: if you're buying a new electrical item, we will recycle your old one for free. Unwanted electrical equipment is the UK's fastest growing type of waste; recycling saves natural resources and prevents hazardous substances leaking into soil and water. Old electrical equipment is marked with a crossed-out wheeled bin symbol — please do not place it in your household bin. Speak to a member of staff for details on disposing of your WEEE item in store or at the time of delivery.
